If you are a financial adviser who provides, or intends to provide, tax (financial) advice services to retail clients, refer to the Commercial Law approved study FP001B Economic and Legal Context for Financial Planning or Commercial Law; and Taxation Law approved study FPC006 Taxation for Financial Planning or Tax for Financial Advising to meet the qualified tax relevant provider requirements under the Better Advice Act.

This course is for financial advisers who provide tax (financial) advice services and wish to be registered with the Tax Practitioners Board (TPB) as a tax (financial) adviser.

The TPB considers it essential a registered agent can demonstrate their knowledge of the Tax Agents Services Act (TASA). This includes the Code of Professional Conduct as part of the requirements for registration and to be able to meet their statutory obligations in relation to the provision of tax agent services.

Kaplan Professional has partnered with The Tax Institute to deliver this course, which meets the TPB’s requirements under TPB (I) 10/2011.

The course provides background and information on TASA 2009 and how it applies to financial advisers. The course also covers registration requirements, transitional provisions, the Code of Professional Conduct, and administrative sanctions and penalties available to the TPB.

Please note: Kaplan Professional’s subject Tax for Financial Advising is a Board approved course in Australian taxation law. Therefore, it encompasses a component in the TASA, including the Code.

Subject Information

On completion of the course, individuals should be able to:

  • Recall the objects of TASA 2009
  • Quantify the Board’s power to apply to the Federal Court for an injunction
  • List their obligations to notify the Board of a change of circumstances
  • Recall the eligibility requirements for registration and any transitional provisions available
  • Recognise the criteria for determining whether an individual is a fit and proper person
  • Understand their obligations to comply with the standards and principles of the Code
  • Link the administrative sanctions that may be imposed for specific breaches of the Code
  • Relate civil penalty provisions to contraventions of conduct of registered and unregistered agents

This course comprises of one e-learning module with four units:

  • Unit 1: The objects of TASA 2009
  • Unit 2: Registration under TASA 2009
  • Unit 3: The Code of Professional Conduct
  • Unit 4: Administrative sanctions and civil penalty provisions

There are no units of competency for this course.

A certificate of completion will be awarded on successful completion of each subject.

Individuals have a total of four weeks to complete the assessment requirements for TASA 2009 and the TPB Code of Professional Conduct from their initial enrolment date.

This subject will take individuals approximately three to four hours to complete.

An additional two weeks is available if individuals are required to re-sit an examination.

Assessment

The ‘TASA 2009 and the TPB Code of Professional Conduct’ is a one subject course.

Assessment for the subject is: 1 exam – Supervised, open book online multiple choice examination, two (2) attempts.

Kaplan’s exams

You must sit your first exam within 4 weeks of your enrolment date.

You are entitled to a first sit and one resit of an exam. To achieve an overall grade of ‘competent’ in the exam, you must achieve the nominated pass mark for each module in the exam. If you are deemed ‘not yet competent’ for a module, you are only required to attempt that module in the resit.

You can sit your exam while being supervised in your workplace or at a Kaplan office.
